These Terms and Conditions form the contract and agreement between User and Ceylinco Insurance Company Pvt Limited unconditionally.
A: GENERAL TERMS
Ceylinco Insurance Company Pvt Limited a company duly incorporated under the company laws of Republic of Maldives bearing registration No C-240/2005 and having its registered office at Level-03 ,H.Marry Side , Boduthakurufaanu Magu,Male’ , Republic of Maldives. (Hereinafter referred to as “CICML”, “We” or “Us” which expression shall unless repugnant to the context or meaning thereof be deemed to include its successors and assigns) owns and maintains, directly or indirectly, www.ceylincoinsuranceplc.com (hereinafter referred to as “the Website” or “the Site”). CICML owns or has license to use all content displayed and used on this Website.
It is prohibited to modify, copy, download, upload, publish, republish, distribute for commercial purposes any or all of the information contained in the Site without prior, explicit written consent from CICML. Any of the above mentioned actions should not amount to violation of any copyrights.
User/you must ensure that all Terms, Conditions and Privacy Policy incorporated in the Terms and Conditions are read carefully prior to accessing information of the Website. By using the Website the User indicates acceptance to be bound by the Terms, Conditions and Privacy Policy.
1. Restraining of Services:
1.1 User may access his / her account through the Website and perform transactions. CICML shall reserve the right to permit or not to permit a user to access the CICML services through the Website. Services may be suspended or impeded on non-compliance of Terms and Conditions or suspected indiscretion.

2. Limitation of Liability and Warranties
2.1 CICML does not guarantee that the Website reflects the most recent amendments/information at a given time although updated periodically. The information on the Website is not an offer for an insurance policy and all CICML policies are subject to their relevant terms and conditions as at date, further details of which can be obtained from policy documents and brochures.
2.2 CICML may have incorporated links to other websites and services on the Website and each such website will be governed by their respective website usage agreements and be subject to these Terms and Conditions. CICML does not control the linked websites and their inclusion does not imply any direct or indirect approval by CICML. CICML disclaims all responsibility for any inaccuracy, error, falsity, omission and/or non-compliance in any material appearing on any linked site.
2.3 Information on the Website is provided without guarantees and/or warranties on accuracy, comprehensiveness, consistency expressed or implied. CICML shall not be held responsible for perceptions, views, ideas gained by a User through information obtained from the Website.
2.4 Under no circumstances shall CICML be held liable for any special, indirect or consequential damages or any damages whatsoever, arising out of or in connection with the use and/or inability to use the Website or use of Services available on the Website.
3. Rights of CICML
3.1 By posting messages and uploading data through the Website a User shall grant a royalty free, unrestricted, continuous license to CICML to use and display such data and exploit any proprietary rights in such data in any manner CICML thinks fit.
3.2 CICML shall monitor the Website and its content, edit and/or remove material in any manner CICML thinks fit. CICML shall also disclose material/data as necessary to suit any law or regulation.
4. Intellectual Property:
4.1 By using the Website the User acknowledges and agrees that the Website and its content are protected by all proprietary rights and laws. All rights are reserved. The User is only allowed to use the Website as specifically set out in the Terms and Conditions. Using the Website does not confer on the User ownership of any intellectual property rights to the Website or its content.

The User shall make fair use of them as specified under these Terms and Conditions and will not use them in a manner which brings disrepute to CICML.
4.3 CICML assumes no responsibility for the violation by the User of any third party copyrights, trademarks, patents, or other proprietary rights and laws of other sites which are linked to the Website.
4.4 Reproduction of the pages and content of the Website in whole or part is prohibited unless for private, non commercial purposes.
4.5 User acknowledges that rights not expressly granted herein are reserved.
5. Email and Downloads
5.1 CICML reserves the right to monitor emails sent from and received by us and shall take action against illegal/ offensive use of the Website. The User accepts that there is no assurance that an email is delivered and that it remains private during communication.
5.2 All downloads shall be used only for private purposes of the User. All downloads are done at the User is at risk. The User shall ensure the suitability of any downloads for his/her computer before attempting to download.
6. Disclaimer:
A User by using the Website acknowledges and agrees that CICML is not liable for any illegal conduct of any User and that any email by the User to CICML via the Internet may not remain confidential or free from intrusion by unauthorized persons during its conveyance.
B: Specific Terms and Conditions
1. Offering of Services:
The Website and its services are offered at the sole discretion of CICML. CICML shall amend, revise, suspend, cancel or withdraw the Website services in whole or in part as and when CICML thinks fit without prior notice to the User. Any addition to the services on the Website shall also be done from time to time which will be notified on the Website itself. Any such addition, amendment, revision, suspension, cancelation or withdrawal shall be binding and effective on the User.
2. Terms of Use:
2.1 By accessing the Website the User unconditionally acknowledges and accepts to be bound by these Terms and Conditions in its entirety.
2.2 The User acknowledges that the information on the Website does not form a recommendation by CICML and that it is at the absolute discretion of the User that decisions to purchase Policies and obtaining of assistance is done.
2.3 The User shall be responsible for any damage, wear and tear or any cost, directly or indirectly attributable to use of this Website and CICML shall not be held responsible for any such damage, wear and tear.
2.4 The User shall not do anything or use any software to disable any of the services of the Website and shall refrain from uploading malicious files/ scripts infected with viruses.
3. Registration and Transactions on Website:
3.1 CICML may expect the User to register to avail all or some of the Services on the Website. User shall use the User ID and Password to access the Website. CICML shall if necessary request for documentary evidence of the same. CICML reserves the right to accept or terminate registration due to erroneous/incomplete information.
3.2 User shall be responsible for the safe custody, protection and confidentiality of the User ID and Password and for all transactions initiated through his User account. User shall be sole authorised user of his User ID and Password. In the event of losing the User ID / Password the User can retrieve it through the procedure on the Website. User shall be responsible for use of the User ID / Password by a third party and shall indemnify CICML against any liability or damage.
3.3 The Website may be temporarily unavailable or restricted for update, repair, administrative or other purposes. The services will be restored as soon as it can be done.
3.4 CICML’s records of account transactions by a User shall be conclusive, accurate proof of such transactions.
3.5 User shall use the Website and its services in a manner that does not conflict with the interests of CICML.
4. Payments through Website
When a transaction instruction is received by CICML through payment mode, CICML shall be permitted to debit any payment along with any charges, taxes from the account specified by User. CICML shall not be responsible or shall not be held liable for any losses if a payment does not go through or is not completed due to a failure on the part of the respective bank.
5. Governing Law & Jurisdiction
Use of this Website shall be governed by the laws of the Republic of Maldives. Although the Website can be accessed worldwide by a User the laws of another country from where these Terms and Conditions are accessed shall not govern them. All disputes shall be subject to the exclusive jurisdiction of Republic of Maldives courts.
6. Miscellaneous
6.1 All account transactions shall be subject to the rules and regulations set out by the relevant authorities including, the government of Republic of Maldives.
6.2 The services/obligations of CICML may be subcontracted and may transfer its rights/obligations to any affiliate.
6.3 Force Majeure events may affect/interrupted the performance of CICML obligations or that of our sub-contractors which shall be excused until such time the force majeure event wears off.
6.4 CICML uses the services of banks for transaction payments. The security and privacy of the websites of such banks are not managed by CICML. CICML shall not be held liable for misuse and/or fraudulent transactions.
6.5 CICML reserves the right to remedy under these terms at all time.
6.6 If any provision(s) under these Terms and Conditions shall be declared invalid, unlawful and/or illegal by any authority, court or tribunal of competent jurisdiction, the same shall become inoperative and shall not have any force and/or effect in any manner, on the legality/validity of the other provisions.
6.7 All disclaimers and exclusions contained in these Terms and Conditions shall survive termination of these terms.
7. Disclaimer
7.1 CICML, its employees, directors and sub-contractors shall not be liable for any direct, indirect or consequential losses/damages arising by the use of the Website and its services by User.
7.2 The User shall indemnify CICML at all times from all losses, costs, expenses and damages arising out of the irresponsible use of the User ID and the breach of these Terms and Conditions by the User.
7.3 CICML makes no warranty regarding Account Transactions performed through the Website.
7.4 If displeased with the Website and/or its services and/or these Terms and Conditions, the sole remedy a User has is to discontinue use of the Website.
8. Refund / Cancellation / Amendment policy
You have a right of cancellation in respect of the payments made to your own insurance policy other than Third Party Motor, Marine, Short Term & Travel Insurance Policies
This right shall expire fourteen calendar days from the day on which either the payment is made by you or your payment is accepted by CICML, whichever date occurs first.
Should you wish to refund, amend or cancel, notice should be sent to (specify) Manager, Ceylinco Insurance Company Private Limited, Level 3, H.Merry Side, Boduthakurufaanu Magu, Maldives or email to xxxxxxx along with the proof of payment. However CICML Insurance reserves the right to suspend any refund which appears that the request is false or not complied with the Terms and conditions specified above.
Further CICML Insurance will not be liable for any loss, damage, expense, costs, delays or other liability whatsoever (including without limitation any financial losses such as loss of profit) which you may incur as a result of any event beyond our reasonable control (including without limitation to any failure of transmission, communication, computer or other facilities or your inability to access the Website for any reason or any failure, error or delay in sending or receiving of any notice or communication or instruction through the post or any electronic medium).
9. Service delivery policy Need to add to website / Need acceptance from Finance
When you offer to make payments on the Website by clicking the ‘Submit’ button, you agree to the terms and conditions specified above. We reserve the right to refuse your payment and in which case you will be notified accordingly.
Your payments can be made by credit or debit cards and thereby the amount/s will be deducted from your card if and when we have accepted your payment. Such payment/s will be allocated to the relevant policies on next working day according to the reference number/s (Eg: Policy Code) entered by you when the payment is processed at our web site. Each payment is acknowledged with a payment reference number and this payment reference can be regarded as an official receipt from CICML Insurance Limited.
